Congress fixes mental health parity deadline for certain bargained health plans

Congress has clarified the effective date for mental health and substance abuse parity rules for collectively bargained plans. The new rules will apply the later of (1) plan years starting on or after Jan. 1, 2010, or (2) the termination date of the last bargaining agreement (CBA) relating to the plan. As originally written, the law could have subjected plans to the rules as early as Jan. 1, 2009. The change is for plans with CBAs ratified before Oct. 3, 2008. Plans under later-ratified CBAs must comply for plan years starting after Oct. 3, 2009. President Bush is expected to sign the measure.  (Select News, 15 Dec 2008)
